Assisted Living Abuse and Neglect

Hundreds of thousands of Americans live in assisted living centers. Although most of these individuals are elderly, some are not.

Many people live in assisted living centers due to problems with Alzheimer’s or dementia. These residents are at risk of wandering from the facility (elopement) during an episode of dementia. As a result, facilities must have adequate safeguards to ensure that residents are safe and do not leave the facility.

Although most assisted living centers have the patient’s best interest at heart, some companies put making huge profits above the residents’ care. Profit-driven homes often neglect their residents or allow them to elope due to inadequate staff training or under-staffing.

Profit-driven assisted living centers often admit residents who require a higher level of care than the center can provide. These individuals should be in a nursing home, which has more staffing and nursing care.

I have represented many families in assisted living elopement cases, including the family of Merle Fall in a lawsuit against Emeritus that was featured in Frontline’s Report Life and Death in Assisted Living.

I have litigated cases against national assisted living chains such as Emeritus/ Brookwood Senior Living and nursing home chains such as Beverly Enterprises/ Golden Living Centers. I am familiar with federal and state regulations governing assisted living centers and nursing homes.

I believe that lawsuits against bad operators of assisted living centers and nursing homes benefit current and future residents. When the bad operators are held responsible for their actions, it leads to improved care for all residents. Families of victims of assisted living center elopement, abuse or neglect should consider filing a lawsuit in order to lessen the chances of similar abuse and neglect to other residents.
