$1.8 million Jury Verdict for Victim of Unnecessary Brain Surgery

Charlie Connetti experienced the nightmare of every person who enters a hospital. Charlie hit his head and experienced headaches. He went to the hospital and a CT scan was performed. The same day, a CT scan was performed on another patient, Mr. King, who was also experiencing headaches. The radiologist who was reviewing the CT scans mixed-up the films and issued the wrong reports for the two patients. As a result, Charlie was diagnosed as having a large cancerous tumor on his brain and brain surgery was scheduled. The patient who really had the brain tumor was told that his head was fine and sent home.

Based on the erroneous radiology report, Charlie underwent brain surgery with a neurosurgeon. The neurosurgeon did not notice the mix-up in the CT scan film even though he had the film during the surgery and the films listed Mr. King’s name sixteen times. The neurosurgeon removed a section of Charlie’s brain looking for the non-existent tumor before aborting the surgery.

When Charlie woke up from the surgery he could not talk and was experiencing other symptoms of a brain injury. The unnecessary had injured Charlie’s brain. Charlie fought to get better for several years.

Charlie hired attorney John Giddens of Jackson to help him. The radiologist denied responsibility for Charlie’s injuries and both Defendants accused Charlie of malingering. When it became apparent that the case would not settle, Mr. Giddens associated Philip Thomas to serve as co-trial counsel. The trial was held in August 2004 in the Circuit Court of Harrison County in Biloxi, Mississippi. The trial lasted over two weeks and included numerous expert and fact witnesses. The jury returned a $1.8 million verdict for Charlie. The verdict also led to the settlement of Mr. King’s claim against the same defendants.
