$700,000 Settlement for Legal Malpractice

In 2005 Philip received a call from a woman who wanted to continue to pursue a claim against a nursing home for abuse and neglect of a loved one by the nursing home. The woman previously hired a lawyer who filed a lawsuit on her behalf, but the case was dismissed for reasons that were not clear to the woman. The lawyer did not explain the reason for the dismissal to the woman.

Philip investigated the matter and determined that the case was dismissed because of malpractice committed by the woman’s attorney.

After the court dismissed the case, the attorney blamed the dismissal on a “crooked judge” and failed to disclose his own negligence to his client. Upon further investigation, Philip discovered that another case was also dismissed after the same lawyer committed the same negligent acts in both cases. After protracted litigation, both cases settled before trial.
